These Terms of Use and Privacy Policy ("Terms") govern your access to and use of conescanada.ca (the "Site") and any purchases made through the Site. By using the Site, you agree to these Terms.
Terms of Use
1. Definitions
For the purposes of these Terms:
“Carrier” means any third-party shipping or delivery provider used to transport orders.
“Customer Content” means any artwork, logo, text, or other content you submit for custom products or projects.
“Custom Products” means made-to-order, printed, personalized, or otherwise customized items.
“Order” means a purchase request submitted through the Site.
“Products” means goods offered for sale on the Site, including Custom Products where applicable.
“Service Providers” means third parties we use to help operate the Site and business (e.g., payment processors, carriers, marketing platforms, analytics providers).
“Personal Information” means information about an identifiable individual, as understood under applicable Canadian privacy laws.
“Business Days” means Monday through Friday, excluding statutory holidays.
2. Who We Are

Service area: We ship across Canada (subject to carrier coverage and restrictions).
3. Eligibility and Legal Age
You may use this Site only if you are of legal age in your province or territory of residence and legally permitted to purchase and receive the Products offered. By using the Site, you confirm you meet these requirements.
4. Use of the Site
You may use the Site for personal use or internal business purchasing. You agree not to:
- Copy, modify, distribute, sell, or exploit Site content except as allowed by law
- Attempt to reverse engineer, disrupt, or compromise Site security
- Use the Site for unlawful, fraudulent, or abusive purposes
5. Intellectual Property
All content on the Site (text, graphics, logos, photos, product descriptions, and design elements) is owned by or licensed to Cones Canada and protected by applicable intellectual property laws.
6. Customer-Provided Artwork and Custom Projects
If you submit Customer Content for a custom project, you represent that:
- You own the rights or have permission to use it
- It does not violate anyone’s rights or any law
Unless you explicitly request confidentiality in writing before production begins, you grant Cones Canada permission to photograph and display finished custom products for portfolio and marketing purposes (without disclosing sensitive business information).
7. Orders, Pricing, and Availability
- Currency: Prices are displayed in CAD unless stated otherwise.
- Cost-driven adjustments: Prices, shipping costs, and availability may change without prior notice due to factors such as currency fluctuation, carrier/fuel costs, and other economic or operational conditions.
- Changes: Prices, product availability, and production capabilities may change at any time without notice.
- Errors: If a listing contains an error (price, description, availability, promotion, or shipping quote), we may correct it and cancel or adjust an Order. If we cancel after payment, we’ll issue a refund to the original payment method.
8. Taxes
Applicable taxes (e.g., GST/HST/PST/QST) are calculated at checkout based on destination and applicable rules.
9. Shipping, Delivery, and Risk of Loss
- We ship from Ontario (or other fulfillment points, if applicable).
- Delivery dates are estimates and not guaranteed. Carrier delays are outside our control.
- Risk of loss/title: Risk of loss transfers to you upon delivery to the Carrier, to the extent permitted by applicable law.
- You are responsible for providing accurate shipping details. Additional costs caused by incorrect addresses or failed delivery attempts may be charged to you.
10. Returns and Refunds
Our Return Policy is published on a separate page and is incorporated by reference into these Terms. In the event of a conflict between these Terms and the Return Policy, the Return Policy will apply to returns, refunds, and exchanges.
11. Payment Disputes and Chargebacks
If you believe there is an issue with an Order, you agree to contact us first so we can try to resolve it. We may provide documentation to payment processors or financial institutions regarding fulfillment, delivery confirmation, and communications.
12. Right to Refuse Service
Cones Canada is committed to a respectful, safe environment. We may refuse service or cancel Orders where permitted by law, including in cases of harassment, threats, fraud, or abusive conduct, consistent with applicable human rights and other laws.
13. Third-Party Links
The Site may link to third-party websites. We do not control or endorse their content and are not responsible for their practices.
14. Disclaimers
The Site and materials are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of Liability
To the maximum extent permitted by law, Cones Canada will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business interruption arising from your use of the Site or Products.
Some provinces/territories do not allow certain limitations, so these limits may not apply to you.
16. Changes to These Terms
We may update these Terms from time to time by posting the revised version on the Site. Changes apply from the effective date listed above or the date posted, as applicable.
17. Governing Law and Venue (Ontario)
These Terms are governed by the laws of Ontario and the laws of Canada applicable in Ontario, without regard to conflict of laws principles. You agree that any disputes will be brought in the courts located in Ontario, Canada.
18. General Legal Terms (Ontario)
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
- Entire Agreement: These Terms (and any policies incorporated by reference, including the Return Policy) are the entire agreement between you and Cones Canada regarding the Site.
- No Waiver: Our failure to enforce any provision does not waive our right to do so later.
- Assignment: We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets, or by operation of law.
- Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control (e.g., carrier disruptions, severe weather, labor disruptions, government actions, or outages).

We respect your privacy and handle Personal Information in accordance with applicable Canadian privacy laws, including PIPEDA, and applicable provincial privacy requirements.

- Shipping/billing: address, province, postal code

- Payment info: payment status and limited transaction details (we do not store full card details; payment processors handle that)
